Kullanım Şartları

Bu Kullanım Şartları (“Şartlar”), Worklab Yazılım ve Bilişim Hizmetleri Ltd. Şti. (“Worklab”) tarafından sunulan hotelbookings.app (“Uygulama”) hizmetine erişiminizi ve kullanımınızı düzenler. Uygulamayı kullanmaya başladığınız anda, bu Şartlar’ı okumuş, anlamış ve kabul etmiş sayılırsınız.

1. Uygulamanın Kapsamı ve Kullanıcı Tipleri

Uygulama, iki kullanıcı tipine hizmet verir:

Seyahat Acentaları (B2B): Admin panel üzerinden konaklama envanteri (villa, bungalov, otel, tiny house vb.) yönetir, odaları ve fiyatları tanımlar, müsaitlikleri Uygulama ve Google Sheets üzerinden günceller.
Son Kullanıcılar (B2C): Uygulamanın ön yüzünden konaklama araması yapar, dilediği birimi seçerek rezervasyon veya satın alma işlemini tamamlar.

Worklab, Uygulama üzerinden teknik altyapıyı ve entegrasyonu sağlar. Konaklama hizmetinin ifası ve içeriklerin doğruluğu, ilgili seyahat acentası/işletmenin sorumluluğunda olabilir.

2. Hesap ve Güvenlik

Seyahat acenteleri için:

Admin panel erişimi için kullanıcı hesabı oluşturulur.
Google Sheets entegrasyonu için gerekli OAuth yetkileri verilebilir.
Hesap bilgilerini korumak ve yetkisiz kullanımı engellemek kullanıcının sorumluluğundadır.

Son kullanıcılar için:

Rezervasyon sırasında sağlanan iletişim bilgilerinin doğru ve güncel olması gerekir.
Yanlış bilgi verilmesinden doğabilecek sonuçlardan kullanıcı sorumludur.

3. Kabul Edilebilir Kullanım ve Yasaklar

Uygulamayı kullanırken aşağıdaki hususlara uymayı kabul edersiniz:

Uygulamayı yürürlükteki mevzuata, kamu düzenine ve genel ahlaka aykırı şekilde kullanmamak,
Başkalarının haklarını ihlal edecek içerik ve işlem yapmamak,
Uygulama ve altyapısı üzerinde tersine mühendislik, yetkisiz erişim veya hack girişiminde bulunmamak,
Başkalarına ait verilere izinsiz erişmeye çalışmamak,
Uygulama üzerinden elde edilen verileri yalnızca amaçlarına uygun şekilde kullanmak.

Worklab, bu kurallara aykırılık hallerinde Uygulama’ya erişiminizi kısmen veya tamamen askıya alma veya sonlandırma hakkını saklı tutar.

4. Üçüncü Taraf Hizmetler ve Google Sheets

Uygulama, Google Sheets ve ilgili Google API’leri ile entegre çalışır. Bu nedenle:

Google hizmetlerinin kullanımı, Google’ın kendi hizmet şartları ve gizlilik politikalarına tabidir.
Google API kotaları, servis kesintileri veya seçeneklerindeki değişiklikler Uygulama’nın bazı fonksiyonlarını etkileyebilir.
Bu tür kesinti ve değişikliklerden kaynaklanan zararlardan Worklab sorumlu tutulamaz.

5. Ücretlendirme

Uygulamanın seyahat acentalarına sunulan kısımlarının ücretlendirilmesi, Worklab ile acenta arasında yapılan sözleşmeler, teklifler veya fiyat tabloları doğrultusunda belirlenir. Son kullanıcıların yaptığı ödemeler ve bu ödemelerin hangi taraf adına tahsil edildiği, ilgili acenta/işletme ile aranızdaki sözleşmeye göre değişiklik gösterebilir.

6. Fikri Mülkiyet Hakları

Uygulama’nın tüm bileşenleri (yazılım kodu, tasarım, marka, logo, alan adı vb.) Worklab veya lisans aldığı üçüncü kişilere aittir ve fikri mülkiyet mevzuatı ile korunmaktadır.

Uygulama’yı yalnızca bu Şartlar kapsamında ve lisans sınırları içinde kullanabilirsiniz.
Kaynak kodunu kopyalayamaz, çoğaltamaz, kiralayamaz, satamaz veya türev eser oluşturamazsınız.
Google Sheets üzerinde yer alan veriler, ilgili seyahat acentasına veya veri sorumlusuna aittir.

7. Sorumluluk Reddi ve Sınırlandırma

Uygulama “olduğu gibi” ve “mevcut haliyle” sunulmaktadır. Belirli bir amaca uygunluk, hatasız çalışma veya kesintisiz erişim konusunda açık veya zımni garanti verilmemektedir.

Worklab; internet altyapısındaki kesintiler, üçüncü taraf hizmet sağlayıcı sorunları (Google API’leri, ödeme sistemleri vb.) ve kullanıcıların kendi sistemlerinden kaynaklanan güvenlik zaafiyetleri nedeniyle ortaya çıkabilecek dolaylı zararlardan sorumlu değildir.

8. Değişiklikler

Worklab, bu Şartlar’ı dilediği zaman güncelleyebilir. Güncel metin, Uygulama içerisinde yayınlandığı anda yürürlüğe girer. Uygulama’yı kullanmaya devam etmeniz, güncellenen Şartlar’ı kabul ettiğiniz anlamına gelir.

9. Fesih

Kullanıcı, dilediği zaman Uygulama kullanımını bırakabilir ve Google hesabı bağlantısını kaldırabilir. Worklab; Şartlar’a aykırı kullanım, kötüye kullanım veya yasal zorunluluk hallerinde, bildirimli veya bildirimsiz olarak Uygulama’ya erişiminizi geçici veya kalıcı olarak durdurabilir.

10. Uygulanacak Hukuk ve Yetkili Mahkeme

Bu Şartlar, Türkiye Cumhuriyeti hukukuna tabidir. Uygulama’nın kullanımından doğabilecek uyuşmazlıklarda, Worklab merkez adresi dikkate alınarak İstanbul (Anadolu) mahkemeleri ve icra daireleri yetkilidir.

Terms of Service

Note: This English version is provided for information purposes. In case of discrepancy, the Turkish version may prevail.

These Terms of Service (“Terms”) govern your access to and use of the hotelbookings.app application (“Application”) provided by Worklab Yazılım ve Bilişim Hizmetleri Ltd. Şti. (“Worklab”, “we”). By accessing or using the Application, you acknowledge that you have read, understood and agree to be bound by these Terms.

1. Scope of the Application and User Types

The Application serves two user types:

Travel Agencies (B2B): Use the admin panel to manage their inventory (villas, bungalows, hotels, tiny houses, etc.), define rooms and prices, and manage availability via the Application and Google Sheets.
End Users (B2C): Use the public interface to search for accommodation, select a property/room and complete a reservation or purchase.

Worklab provides the technical infrastructure and integration through the Application. The provision of accommodation services and the accuracy of property information may be under the responsibility of the relevant travel agency or property operator.

2. Accounts and Security

For travel agencies:

User accounts are created to access the admin panel.
Google OAuth authorization may be granted for Google Sheets integration.
It is the user’s responsibility to keep account credentials confidential and prevent unauthorized use.

For end users:

Contact details provided during reservation must be accurate and up to date.
Users are responsible for any consequences arising from incorrect or incomplete information.

3. Acceptable Use and Prohibited Activities

When using the Application, you agree that you will not:

Use the Application in violation of applicable laws, public order or general morality,
Infringe the rights of others or upload unlawful content,
Attempt to reverse engineer, hack or gain unauthorized access to the Application or its infrastructure,
Attempt to access other users’ data without permission,
Use data obtained via the Application for purposes other than those intended.

Worklab reserves the right to suspend or terminate your access to the Application in case of violation of these rules.

4. Third-Party Services and Google Sheets

The Application integrates with Google Sheets and related Google APIs. Therefore:

Your use of Google services is subject to Google’s own terms of service and privacy policy.
Changes in Google APIs, quotas or service availability may affect certain features of the Application.
Worklab cannot be held liable for damages arising from disruptions or changes in such third-party services.

5. Fees and Payment

Services provided to travel agencies may be subject to fees as specified in contracts, offers or pricing tables agreed between Worklab and the agency. The amounts paid by end users and on whose behalf such payments are collected may vary depending on the agreements between the agency/property and the user.

6. Intellectual Property

All components of the Application (software code, design, trademarks, logos, domain name, etc.) are owned by Worklab or its licensors and are protected by intellectual property laws.

You may use the Application only within the scope of these Terms and the license granted.
You may not copy, reproduce, rent, sell or create derivative works from the source code.
Data stored in Google Sheets belongs to the respective travel agency or data owner.

7. Disclaimer and Limitation of Liability

The Application is provided on an “as is” and “as available” basis. Worklab makes no representations or warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, error-free operation or uninterrupted availability.

Worklab shall not be liable for indirect, incidental, consequential or special damages arising from the use or inability to use the Application, including but not limited to data loss, loss of profit or business interruption, to the extent permitted by applicable law.

8. Changes to the Terms

Worklab may update these Terms from time to time. The updated Terms will become effective when published within the Application or otherwise communicated to you. Continued use of the Application after such changes constitutes your acceptance of the updated Terms.

9. Termination

You may stop using the Application at any time and, where applicable, revoke Google account access. Worklab may suspend or terminate your access to the Application in whole or in part in case of breach of these Terms, misuse of the service, or where required by law.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye. Any disputes arising out of or in connection with the Application shall be subject to the jurisdiction of the courts and enforcement offices of Istanbul (Anatolian side).
